• TERMS & CONDITIONS •

ACCEPTANCE
By commissioning my services, the client confirms that they have read, understood and accepted these terms in their entirety. It is to the client’s responsibility to take knowledge of these terms before requesting of services.
These Terms and Conditions (T&Cs) apply equally to both parties and are intended to protect each of them.
For any questions regarding these T&Cs, I can be contacted by email or privates messages as stated below.COMMUNICATION
I am committed to transparent communication throughout the project. I will respond to messages within a reasonable time. Regular updates will be provided to the client at each stage of the project.
Client may share any references they like with me, as long as it respects the limits stated below. (Cf. section ‘LIMITS & REFUSALS’)

Completion time is typically 1-5 weeks, depending on complexity and current workload. A specific deadline will be discussed for each project and agreed by both the client and I.REVISIONS
Are included by default :
• Sketch/concept stage : up to 3 revisions
• Flat/rendering stage : up to 3 minor revisions
Major revisions/changes beyond the original agreed concept may incur additional fees to be discussed before implementation.DELIVERY
Final files will be delivered in PNG, JPEG and TIFF format, at a resolution of 600 DPI, or lower upon request and mutual agreement.
Files will be sent by email only, upon full settlement of the invoice. No physical copy will be sent to the client.PAYMENT & INVOICING
A quote can be requested by the client or issued before beginning of the project. An invoice compliant with French law will be issued for each payment, written in French along English translation.
Commissions of 100€ or less must be paid upfront before any work begins.
Commissions over 100€ will be processed in two payments :
• A deposit, due immediately after mutual agreement and before any work begins (50%)
• A final payment, prior to delivery (50%)
The client may choose to pay the full amount (100%) upfront if desired. Full payment upon delivery is not accepted.
In cases of late payment, a fixed recovery fee of 40€ + interest at ECB rate+10 points will apply. (Art. D 441-5 of the Commercial Code)
Payments are only accepted via Square (credit/debit card). A secure payment link will be provided by email.
This payment structure is fixed and non-negotiable unless I explicitly offer it first.CANCELLATIONS & REFUNDS
Both the client and I are able to cancel collaboration at any time, as per terms below.
1. Cancellation by client
Before deposit : Client may cancel at any time if they change their mind before any payment and work begins.
After deposit : Client may cancel at any time before delivery, but the deposit (50%) is non-refundable. If the client paid fully upfront (100%), a partial refund of 50% will be offered.
After delivery : Given the nature of the service (digital service with digital delivery), no refund can be requested after delivery if the client is not satisfied.
Apply EU Directive 2011/83/EU on consumer rights and Art. L221-28 of the French Consumer Code.2. Cancellation by artist
If I must cancel the project for any reason (inability to complete, discomfort with requested content, etc...), a full or partial refund will be issued based on work already completed.
If client does not respond for longer than 30 days without notice, I will be considering the commission void and reserve the rights to not follow through the project, should the client return. No refund will be issued in this case.

LIMITS AND REFUSALS
I reserve the rights to decline any commission request for any reason.
I will not accept or create content that :
• Violates any laws or regulations
• Promotes illegal activities, content or harm
• Contains hate speech or discriminatory imagery
• Goes against my personal values or make me uncomfortable
If after accepting a commission, new requests or changes make me uncomfortable or involve content I am unwilling to create, I reserve the right to cancel collaboration or refuse new requests from the client. In such cases, a full or partial refund will be issued based on work already completed.LIABILITY
I, the artist, cannot be held responsible for :
• Incorrect use of the artwork by the client
• Technical issues on the client’s side (loss of files, inability to open files, etc…)
• Delays caused by late/insufficient communication from the client
• Copyright violations by the clientUSAGE RIGHTS & COMMERCIAL USE
Unless stated otherwise, all commissions are for personal use only. This includes :
• Use on client’s personal social media
• Printing for personal use
• Personal avatar/banner/etc…
Commercial use requires the purchase of a commercial license in addition to the commission price. License fees are negotiated per project.
If the use change after delivery, the client must request and pay for a commercial license.PROHIBITED USE
The client must not under any circumstances :
• Resell the artwork (to anyone or as NFT)
• Use the artwork to train or feed any Artificial Intelligence systems, image generation models, or any similar service
• Claim to be the creator of the artworkARTIST RIGHTS & CREDIT
I retain all copyright to the created artworks. The client receives an usage license according to the defined terms (personal or commercial use). I reserve the right to use completed commissions or WIP (work-in-progress) for :
• Online and physical portfolio
• Social media
• Promotion of my services
Unless explicitly requested otherwise by the client. Promotional versions may include watermarks such as ‘Commission – Do not use’ or similar.
When sharing the artwork publicly, the client must provide clear credit to the artist, with a link or tag (@) when possible.CREATIVE PROCESS
No Artificial Intelligence (AI) is used in my creative process. All artworks are created manually and originally.PRIVACY AND PERSONAL DATA
1. Artist’s privacy
All personal and professional information of the artist provided in invoices or official documents is strictly confidential.
The client agrees to :
• Not share this information
• Not post invoices or documents containing this data on social media or other public platforms
• Use these documents only for personal accounting and legal purposes
Violation of this clause constitutes a serious breach of these terms.2. Client data protection
In accordance with GDPR (EU Regulation 2016/679) and French data protection laws, all personal data collected (name, email, address, payment information, …) is only used to :
• Fulfill the commission service
• Invoicing and accounting purposes
• Legal and taxes obligations
Client’s data will not be shared with third parties without explicit consent, except :
• When required by law or legal obligations
• Payment processor (ie. Square) necessary to settlement of the invoice
As per same French law, client’s information in invoices is kept for a legally required period of 10 years, then securely deleted. Client reserves the right to access, correct and request to delete personal data, and may do so by contacting me through email.
